<h2>Here&rsquo;s what has been trending on the CoatingsCoffeeShop&trade; (CCS) newsroom this past month.&nbsp;</h2>

<p>Since launching this website a month ago, we love getting to see what topics the roof coatings industry is most interested in. One of our most-read articles from this last month came to us from <a href="https://www.rooferscoffeeshop.com/directory/trent-cotney-rcs-influencer" target="_blank">Trent Cotney</a>, partner at <a href="https://www.rooferscoffeeshop.com/directory/adams-and-reese-llp" target="_blank">Adams and Reese,</a> who discusses House Bill 2127 in Texas. Trent does a terrific job outlining exactly what this new law means for construction workers in Texas. He also discusses the reasoning behind the law and the concerns held by the law&rsquo;s opponents.&nbsp;</p>

<title>Will This New Texas Law Put Construction Workers at Risk?</title>

<h2>With heat waves sweeping the nation, this new law may eliminate regulations put in place to keep outdoor laborers safe. Learn more about the potential impacts and what to expect in the future.&nbsp;</h2>

<p>With rising temperatures across the nation, cities everywhere are facing extreme summer heat. The construction industry has been particularly impacted, and many city ordinances are stepping in to protect workers. Texas is no stranger to summer heat, but a new Texas law may eliminate the regulations that work to mitigate heat-related injuries and death on worksites. Opponents worry about the implications of such changes.&nbsp;</p>

<h3>What the law stipulates&nbsp;</h3>

<p>The new law nullifies local ordinances that have been in effect throughout the state, and it prohibits future local ordinances from being adopted. While its scope is rather broad, the minimum workplace water breaks are among the law&rsquo;s specific targets. Regulations in Austin and Dallas called for ten-minute water breaks every four hours. The intent of those ordinances was to allow workers the time to seek shade and hydrate. San Antonio had been debating a similar mandate but now will not be allowed to consider it.&nbsp;</p>

<p>The Texas legislature passed <a href="https://capitol.texas.gov/tlodocs/88R/billtext/pdf/HB02127F.pdf" target="_blank">House Bill 2127</a> in April of this year, and Governor Greg Abbott signed the bill into law in June. It will go into effect on September 1.&nbsp;</p>

<h3>Understanding the risk for construction workers&nbsp;</h3>

<p>More workers die from heat exposure in Texas than in any other state. According to data from the U.S. Bureau of Labor, there were at least 42 heat-related deaths for workers in Texas between the years 2011 and 2021. However, that statistic may be misleading because many heat-related deaths can be attributed to other causes of injury. According to data from the U.S. Census Bureau, Latino workers are the most affected.&nbsp;</p>

<p>Heat waves can be severe, often proving more dangerous than other extreme weather events, such as floods and tornadoes. Last year, Texas experienced a drought and its second-hottest summer.&nbsp;</p>

<p>Union leaders are concerned that heat-related deaths will increase when the water breaks are eliminated.&nbsp;</p>

<p>&ldquo;Construction is a deadly industry. Whatever the minimum protection is, it can save a life. We are talking about a human right,&rdquo; said Ana Gonzalez, Texas AFL-CIO deputy director of policy and politics. &ldquo;We will see more deaths, especially in Texas&rsquo; high temperatures.&rdquo;&nbsp;</p>

<h3>Reasoning for the law&nbsp;</h3>

<p>State Rep. Dustin Burrows (R-Lubbock) introduced the bill, which has become a solid attempt to curb local laws that go beyond state laws, specifically in areas related to natural resources, labor and agriculture.&nbsp;&nbsp;</p>

<p>Supporters of the legislation believe that water breaks are unnecessary since OSHA already requires that workers have a safe environment. They contend that work safety issues are best left to OSHA, not to local lawmakers. In addition, many businesses celebrate the law since it will prevent them from being affected by local regulations.&nbsp;</p>

<h3>Concerns about the law&nbsp;</h3>

<p>Some people who oppose the legislation point out that OSHA requirements are insufficient. OSHA mandates that employers protect their workers, but Texas workers are still dying from heat exposure. Although NIOSH has a recommended heat standard, and several states have their own heat standards, OSHA does not have a national heat standard. Therefore, the agency issues citations only after injury or death resulting from heat exposure. Opponents claim that OSHA takes no preventative action beforehand.&nbsp;</p>

<p>Other opponents are concerned that the law will have ramifications beyond the elimination of water breaks. They worry that local governments will be constrained from taking other actions, such as averting tenant evictions, controlling excessive noise and deterring predatory lending.&nbsp;</p>

<h3>What to expect next&nbsp;</h3>

<p>While HB 2127 prohibits the local ordinances for water breaks, it does not prevent the pursuit of a state law. During the regular legislative session, lawmakers introduced two bills related to the issue.&nbsp;</p>

<p><a href="https://capitol.texas.gov/BillLookup/History.aspx?LegSess=88R&amp;Bill=HB495" target="_blank">House Bill 495</a> would have led to a state law mandating 10-minute breaks every four hours for contractors employed by a governmental entity. <a href="https://capitol.texas.gov/BillLookup/History.aspx?LegSess=88R&amp;Bill=HB4673" target="_blank">House Bill 4673</a> would have created a state advisory board to establish heat-prevention standards and set penalties for noncompliance. However, neither bill was successful.&nbsp;&nbsp;</p>

<p>It will be interesting to see how local governments react to the new law. In the meantime, employers are urged to comply with OSHA safety guidelines and ensure their workers are protected from heat and other factors.&nbsp;&nbsp;</p>

<p>The <a href="https://www.rooferscoffeeshop.com/directory/north-texas-roofing-contractors-association">North Texas Roofing Contractors Association</a> (NTRCA) &ndash; a regional association for professional residential and commercial roofing contractors, distributors, manufacturers and associates who maintain the highest industry standards &ndash; announces this year&rsquo;s 2021 board of directors and 2021 award winners.</p>

<p>During the NTRCA Awards Banquet, held March 26, 2021 at the Fort Worth Zoo, the winners of the annual &ldquo;Industry Leader of the Year&rdquo; award and the &ldquo;Associate of the Year&rdquo; award were announced and recognized for their significant contributions to the North Texas roofing industry. Past winners meet annually to choose each year&rsquo;s new honoree in each category.</p>

<p>The &quot;Industry Leader of the Year&quot; honor, the association&#39;s most prestigious recognition, was awarded to Catherine Awtrey, president of Texas Roof Management. The &quot;Associate of the Year&quot; honor was awarded to Ray Buckner, now retired from <a href="https://www.rooferscoffeeshop.com/directory/johns-manville-2">Johns Manville</a>.</p>

<p>The 2021 NTRCA board members were also sworn in during the NTRCA Awards Banquet.&nbsp;</p>

<h2>NRCA is supporting a proposal from Standard Industries for tax incentives to stimulate demand for construction.</h2>

<p>Standard Industries, the parent company of GAF, is proposing that the federal government consider a 30 percent federal tax credit for the cost of improvements to residential and commercial buildings. National Roofing Contractors Association (NRCA) said they believe that the &ldquo;proposal could be particularly beneficial to the roofing and construction industries to the extent that the COVID-19 pandemic continues to put pressure on homeowners and commercial building owners to delay and cancel construction projects in the medium and long-term.&rdquo;&nbsp;</p>

<p>The construction industry employs 10 million workers and generates $450 billion in wages every year. The proposed 30 percent tax credits would deliver urgently needed relief to the industry and to the workers whose livelihood is tied to the construction industry.</p>

<p>An overview of the issue provided by Standard Industries shares that homes represent 50 percent of total household assets in the United States and 65 percent of Americans are homeowners. Many residential projects have been delayed or stopped due to the impacts of the COVID-19 crisis. With record unemployment, owners are reluctant to undertake home improvement projects. The proposal overview states that&nbsp;&quot;helping Americans make needed and valuable repairs to their homes is more important than ever.&rdquo;</p>

<p>Businesses are also being forced to make changes in order to follow recommended Centers for Disease Control guidelines in order to open and operate safely. It&rsquo;s more important than ever that Americans feel they have a safe home and a secure job that is following social distancing and has implemented to needed safety improvements.</p>

<p>A letter being sent to key members of Congress along with President Trump, says that &ldquo;proposed tax credits serve as an opportunity to counter this devastation, improving individual prosperity and supporting the economic recovery.&rdquo;</p>
